Greetings from TQ VTU. The TQ VTU application and any associated services (collectively, the “Service”) are subject to these Terms of Use (“Terms”), which control your access to and use of TQ VTU (“we,” “us,” or “our”). You acknowledge that you are bound by these Terms by using the Service. You must stop using our service right away if you disagree with these terms.
Account Registration and Security
To use the Service, you must first register an account by entering correct and complete information. We are under no obligation to open or maintain an already opened account unless you produce all essential papers and complete the KYC procedure as specified by the Central Bank of Nigeria (‘CBN’) and other applicable authorities from time to time.
We have the right to refuse to open or close an account if we determine that the information used to create the account is fraudulent, erroneous, or misleading. You must meet the minimum balance requirement, if one exists, as well as any other requirements that apply to your accounts. Failure to comply will result in the suspension or closure of your accounts.
Each time you access your account or transmit instructions, we must validate that we are dealing with you and verify your security details. If entered correctly, we assume you are the one issuing directions.
You are responsible for the confidentiality of your account credentials as well as all activities that take place under it. Please notify us immediately if you suspect an unauthorized use of your account.
Orders and Payment to your Account
If we make a payment to you by mistake or through a system error, we shall deduct the amount without telling you. If a payment is made to you and we suspect fraud, we will cease it without alerting you. If we are notified that a payment to your account was not meant for you, we will notify you and investigate the circumstances at hand. If you insist it was for you, we will keep it in your account, but you may be restricted from accessing your account.
In addition, we may be compelled to watchlist your BVN, but we will only do so if required by law. The person claiming the error may seek additional legal remedies, and we will be obligated to adhere with the law or order of the court or regulatory authority, as the case may be.
**TQ VTU does not allow users to transfer money from their account to any bank or financial organization that provides banking services. Funds deposited into your account are only used to pay for the services we provide. As a result, proceed with caution and only deposit funds that will be used to pay for the services we provide.
Also, we are obligated to make payments from your account; but, we may not do so in certain circumstances, including but not limited to the following:
- You have insufficient funds.
- We are aware that you have given us incorrect details.
- Payment is over/below a limit, which we will notify you of when you attempt to pay.
- We suspect there has been fraud, breach of security, or breach of law or regulation.
- We suspect that someone else may have a claim to the money.
**All transactions done through the Service imply that you authorize us to do so and are subject to the terms and restrictions outlined on this page. We are not liable for any errors or delays caused by you, third parties, or partners in processing any transaction on your behalf.
Fees and Charges
For some services that we offer, there can be fees and charges that apply to you. You will be informed of any applicable fees and charges prior to your incurrence. All fees and costs related to your usage of the Service are your responsibility.
Account Cancellation, Suspension, or Removal
We may terminate or suspend your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason not limited to:
- suspicions of criminality or fraud
- Non-compliance with the law
- Suspicion that your account’s security has been breached
**If your account has not been used for an extended length of time, we may restrict usage to protect your account, always with warning. If your account has been dormant for 6 months or more, it may be restricted due to non-usage. In any situation, we will notify you before or immediately after restricting your account and explain why we made the decision. Furthermore, we have provided you with the option to delete your account; however, this does not imply that any information we hold about you will be deleted. We reserve the right to remove or keep such information.
Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:
- Use the Service in any manner that could disable, overburden, damage, or impair the Service.
- Attempt to gain unauthorized access to any part of the Service or its related systems or networks.
- Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose.
- Use the Service to engage in any fraudulent, illegal, or harmful activities.
Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share your information. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.
Intellectual Property
The Service and its entire contents, features, and functionality are owned by [Bank Name], its licensors, or other providers of such material and are protected by intellectual property laws. You may use the Service only for your personal, non-commercial use.
Disclaimers and Limitation of Liability
The Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. To the fullest extent permitted by law, we disclaim all warranties, express or implied, and shall not be liable for any damages of any kind arising from the use of the Service.
Governing Law
These Terms and their interpretation are governed by the laws of the Federal Republic of Nigeria. Any problem or issue emerging under this Agreement shall be handled by amicable negotiation. Where amicable settlement fails, disagreements and concerns will be heard by the Federal Republic of Nigeria’s courts. For our advantage, you hereby submit to the exclusive jurisdiction of the Federal Republic of Nigeria’s courts and waive all objections to the forum. Nothing in this Agreement prevents us from bringing proceedings against you in any other jurisdiction, concurrently or not.
Changes to These Terms
We retain the right to amend these Terms of Service at any time. If we make any substantial changes, we will notify you in advance using one of the following methods:
- By publishing the revised Terms of Service on our platform
- By sending an email notification to the email address linked to your account,
- By presenting a prominent notice in the application.
It is your duty to frequently examine the Terms for updates or modifications. Unless otherwise noted in the notification, all changes take effect immediately after they are posted. If you do not agree to the amended Terms, you must discontinue using the Service. Your continued use of the Service after the revised Terms have been posted and become effective shall constitute your acceptance of the new Terms.
